Legal aid for divorce and family proceedings in England and Wales was significantly restricted in 2013. For the vast majority of people going through divorce, financial remedy proceedings or disputes over child arrangements, legal aid is simply not available. This is not a reflection of how serious or complex your situation is. It is a result of government policy that has left many people navigating the family court system without the financial support to access full legal representation.
When is legal aid still available?
Legal aid for family matters remains available in a limited set of circumstances, primarily where there is evidence of domestic abuse, child abduction or a risk of homelessness. For the majority of people going through divorce and separation, it is not an option regardless of income.
What does this mean in practice?
It means that a very large number of people are navigating financially significant, emotionally complex legal proceedings without professional support, or are stretching their finances to pay for solicitor time they can barely afford. Neither is a good position to be in.
What are the alternatives?
There are practical alternatives that can make a significant difference without requiring legal aid or full solicitor representation:
- Representing yourself as a litigant in person, with practical support from a McKenzie Friend alongside you
- Using mediation to reach agreements before matters escalate to contested court proceedings
- Using a solicitor on a targeted basis for specific advice at key moments, rather than throughout
- Working with a separation support practitioner for the practical, organisational and emotional aspects of the process
